Advertising one spirit and serving something else is called passing off and it is illegal. Our stocktakers are able to test well-known spirit brands to ensure they are genuine. This gives you that further piece of mind that none of your sites are “Passing Off”. This additional test is recorded and reported in your stock report. The data should then be kept for Due Diligence records.
Definition of Passing Off :- A cause of action for passing off is a form of intellectual property enforcement against the unauthorised use of a mark which is considered to be similar to another party’s registered or unregistered trademarks. In terms of the licensed trade, it would be where a site is advertising the sale of a well-known brand but in fact selling a cheap alternative.
